New Hampshire Statute of Limitations on Debt Collection
The statute of limitations is an established rule that sets a time limit within which a creditor is able to sue you for payment of a debt. The amount of time that a creditor has to sue you is different for each state and if the time that is allowed by your state has passed, a creditor is unable to sue you for the debt. In New Hampshire:
- Contracts and open accounts: 3 years (RSA 508:4)
- Judgments, recognizance, and contracts under seal: 20 years (RSA 508:5)
- Notes secured by a mortgage: 20 years (RSA 508:6)
- Notes, defined as negotiable instruments: 6 years (RSA 382-A: 3-118)
If the debtor makes a payment on the account, there is a toll on the statute of limitations.
