Arkansas Statute of Limitations on Debt Collection

The statute of limitations is an established rule that sets a time limit within which a creditor is able to sue you for payment of a debt. In Arkansas, there is a statute of limitations for written contracts of 5 years. However, if the collector convinces the consumer to make a payment, the statute of limitations will start over since a partial payment (A.C.A. 16-56-111).

The majority of lawsuits against consumers are for breach of contract. It is important for consumers to know that there is a statute of limitations for a breach of contract action. Contracts in Arkansas that are not in writing have a statute of limitations of 3 years (A.C.A. 16- 56-105).

If a debt was the result of a medical service, there is a statute of limitations of 2 years from the date of service or from the date that the consumer made a partial payment (A.C.A. §16-56-106).
