Montana Statute of Limitations on Debt Collection

The statute of limitations is an established rule that sets a time limit within which a creditor is able to sue you for payment of a debt. The amount of time that a creditor has to sue you is different for each state and if the time that is allowed by your state has passed, a creditor is unable to sue you for the debt. In Montana:

  • Judgments of decrees in a U.S. court: 10 years
  • Judgments rendered in a court not of record: 6 years
  • Verbal contracts, accounts or promises: 5 years
  • Verbal obligations that are not contracts: 3 years
  • Written contacts, obligations and liabilities: 8 years

In Montana, a written acknowledgment that is signed by the debtor or any payment on the debt will cause the statute of limitations to start over.
