Arizona Statute of Limitations on Debt Collection

When a creditor files a lawsuit against a consumer, it is usually for a breach of contract. When a consumer takes on a debt, it is an actual contract that says they have to pay the debt in exchange for the credit received to make purchases. If it is a contract case, the statute of limitations will start once the contract has been breached. Although each state varies in terms of when a breach has technically happened, the ultimate breach will usually not happen until the account is charged off. This will occur after the payment has been delinquent for 180 days.

Before a consumer agrees to pay off their debt, they should check what the statute of limitations is for their state to ensure that the debt is still due and payable. In Arizona:

  • Actions for fraud/mistake-3 years from the date of the discovery of the fraud/mistake
  • Oral debts, stated or opens accounts- 3 years
  • Written contracts-6 years
